By accessing or using the Easy.Green file sharing services, you agree to be bound by these Terms of Service. Please read them carefully before you use our services. If you disagree with any part of these terms, please refrain from using our services.

 

2. Service Overview

Easy.Green provides a platform for sharing digital files over the internet. Our services enable users to upload, store, and share files, subject to the stipulations of these Terms. The specific features and functionality of the services are dynamic and may vary.

 

3. Eligibility

To be eligible to use the services provided by Easy.Green, you must be at least 16 years old. By accessing or using our services, you represent and warrant that you are 16 or older. Any use of the services by individuals under the age of 16 is strictly prohibited and constitutes a violation of these Terms of Service.

 

4. User Obligations and Conduct

As a user of Easy.Green services, you commit to conduct yourself responsibly. You agree that you will not violate any laws or regulations, infringe on any person’s rights, or breach any of the terms outlined in this document.

 

5. User Conduct and Content Guidelines

By using our services, you affirm that for any content you create, use, store, or share using the Services, you have obtained all necessary permissions (including those from copyright and other intellectual property rights owners). This includes the rights to distribute, sub-license, transfer, store, and/or make the content available online as part of the Services. You bear sole responsibility for securing these permissions.

When using Easy.Green services, you must adhere to certain conduct guidelines. This includes respecting the rights of others, such as privacy, intellectual property, and trade secrets. Our services must not be used for illegal or harmful activities. More specifically, you commit not to generate, store, or disseminate content through our services that:

  • Is of an obscene, defamatory, libellous, slanderous, profane, indecent, discriminatory, menacing, abusive, harmful, lewd, vulgar, or illicit nature;
  • Encourages racism, violence, or hatred;
  • Is factually incorrect, false, misleading, misrepresentative or deceptive;
  • Is generated, used, stored or disseminated without the necessary legal rights;
  • Breaches, infringes or misappropriates intellectual property rights, privacy rights (including data protection rights), and/or any other type of rights;
  • Contravenes or infringes any applicable law or regulation;
  • Represents ‘hate speech’, whether targeted at an individual or a group, based on race, sex, creed, national origin, religious affiliation, sexual orientation, language, or any other defining characteristic.

Non-compliance with any of these guidelines may result in the termination of your access to our services, as laid out in clause 9.

 

6. Protection of Intellectual Property

Easy.Green and its licensors own all intellectual property rights related to our services. This includes, but is not limited to, the software, designs, logos, trademarks, trade names, domain names, copyrights, and patents associated with our services. You agree not to misuse, modify, copy, or distribute any of these materials without explicit permission from Easy.Green or the relevant licensor.

 

7. Respect for Privacy and Personal Data

At Easy.Green, we are committed to protecting your personal information. The way we collect, use, and safeguard your data is outlined in our Privacy Policy. By agreeing to these Terms of Service, you also agree to the terms outlined in our Privacy Policy.

 

8. Content Retention After Subscription Termination

Be aware that Easy.Green has the authority to automatically erase all content that you have uploaded and that remains on our servers 45 days after the termination of your Easy.Green subscription or the file upload date, unless otherwise specified by your account administrator. Once removed, the content will not be recoverable.

 

9. Changes to Our Service

We aim to continuously improve our services and may change, suspend, or discontinue any aspect of our services at any time. We may also limit certain features or restrict your access to parts or all of our services without notice or liability.

 

10. Service Termination

Easy.Green reserves the right to terminate or suspend your access to our services at our discretion, without notice and liability, for any reason, including but not limited to breach of these Terms of Service. Following termination, your right to use our services will immediately cease.

 

11. Warranty Disclaimer

Easy.Green provides its services « as is » and « as available » without any warranties or representations of any kind, either express or implied. We do not make any warranties that our services will meet your requirements or that our services will be uninterrupted, secure, or error-free.

 

12. Limitation of Liability

To the maximum extent permitted by law, Easy.Green will not be liable for any direct, indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services.

 

13. Changes to These Terms

Easy.Green reserves the right to revise these Terms of Service from time to time. The revised terms will take effect from the date of their posting on our website and/or mobile/desktop application, or on a later date specified within the revised terms. We recommend reviewing these Terms periodically for any updates or changes. Continued use of our services after the posting of changes implies your acceptance of these changes. In case of significant changes, we will inform you via a service notice, a message to your provided contact details, or a post on our website and/or application.

 

14. Governing Law and Jurisdiction

These Terms of Service, as well as any disputes or claims that arise from or in connection with them, will be governed by the internal laws of France without regard to any choice or conflict of law provision or rule. Any legal action or proceeding arising from or related to these Terms or our services shall take place exclusively in the courts of France.

 

15. Entire Agreement

These Terms of Service and any other legal notices we publish on our website or on our mobile/desktop application constitute the entire agreement between you and Easy.Green. These terms supersede all prior or contemporaneous communications and agreements, whether electronic, oral, or written, between you and Easy.Green.

 

16. Governing Language

These Terms of Service are also provided in French for your convenience at Conditions Générales d’Utilisation. However, the English version of these Terms of Service is the definitive version and the only one legally applicable. In the event of a discrepancy or inconsistency between the French translation and the English version, the English version shall prevail.
